1. Scope and Contracting Parties
1.1 These General Terms and Conditions (GTC) apply to all orders placed through the NX 3D online shop.
1.2 The online shop operates under the brand name NX 3D.
1.3 The seller and contractual partner for the purchase of the ordered goods is the business entity identified during the checkout process, in the order confirmation, or on the invoice.
1.4 NX 3D operates the online shop and provides customer support for orders, payments, shipping, returns, and complaints.
1.5 For consumers, mandatory legal provisions applicable in their country of habitual residence remain unaffected, insofar as such provisions apply.
2. Conclusion of the Contract
2.1 The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.
2.2 By submitting an order, the customer makes a binding offer to conclude a purchase agreement for the selected products.
2.3 The purchase contract comes into effect when the order is expressly confirmed by NX 3D or when the ordered goods are shipped, unless otherwise stated during the ordering process.
3. Prices and Import Costs
3.1 The prices displayed in the online shop at the time the order is placed apply.
3.2 NX 3D ships products internationally. Shipping costs are displayed on the website and/or during checkout.
3.3 Depending on the destination country, customs duties, import taxes, fees, or other import-related charges may apply.
3.4 Unless expressly stated otherwise before the order is placed, any customs duties, import taxes, or other charges imposed by the destination country are the responsibility of the customer or recipient.
3.5 Import-related processing may be handled by a carrier, freight forwarder, customs agent, or other service provider commissioned for the shipment. This may include customs declarations, import processing, and the payment or collection of applicable duties and fees.
3.6 Delays, additional costs, or returns resulting from the customer or recipient failing to provide required information, cooperate with the delivery process, or pay applicable import-related charges in a timely manner shall be borne by the customer or recipient, to the extent permitted by applicable law.
4. Payment
4.1 Customers may use the payment methods displayed during checkout.
4.2 Payment processing may be handled by external payment service providers.
4.3 Orders are only processed after successful payment authorization or confirmation, unless another payment arrangement is expressly offered during checkout.
5. Delivery and Cancellation
5.1 Delivery times, shipping methods, and shipping costs are stated on the website and/or during checkout.
5.2 Orders are generally processed within 1–3 business days, excluding weekends and public holidays.
5.3 Standard delivery is estimated at 7–15 business days after shipment, depending on the destination and other circumstances affecting delivery.
5.4 Cancellation is possible as long as the order has not yet been processed or handed over to the shipping provider.
5.5 Once an order has been processed or shipped, cancellation may no longer be possible. In such cases, consumers may exercise any applicable statutory right of withdrawal in accordance with our Cancellation Policy / Right of Withdrawal.
6. Cancellation and Returns
6.1 Consumers may have a statutory right of withdrawal in accordance with our Cancellation Policy / Right of Withdrawal and applicable law.
6.2 Where applicable, the right of withdrawal must be exercised by submitting a clear declaration, for example by email to support@nx3d.com.
6.3 Unless otherwise stated in our cancellation and return policy or required by applicable law, the customer is responsible for the direct costs of returning an item.
6.4 Refusal to accept a shipment or failure to collect a shipment does not automatically constitute a valid cancellation or withdrawal. Where legally permissible, additional costs resulting from refusal to accept, failure to collect, failure to cooperate with delivery, or failure to pay applicable import charges may be deducted from a refund or charged separately, provided the customer has been appropriately informed.
7. Warranty and Defects
7.1 The statutory warranty rights applicable to the purchase remain unaffected.
7.2 Customers are encouraged to inspect the goods upon receipt for obvious defects or transport damage and to contact NX 3D as soon as possible if a problem is identified.
7.3 Reporting a defect after the goods have been received does not limit or replace any statutory rights the customer may have.
7.4 For warranty claims, customers may be asked to provide clear photographs and other information necessary to assess the alleged defect.
8. Liability
8.1 NX 3D's liability is unlimited where liability is mandatory under applicable law, including in cases of intent, gross negligence, or damages resulting from injury to life, body, or health where legally applicable.
8.2 In the event of a slightly negligent breach of essential contractual obligations, liability is limited to foreseeable damages that are typical for the type of contract, to the extent such limitation is legally permissible.
8.3 Essential contractual obligations are obligations whose fulfillment is necessary for the proper performance of the contract and on whose fulfillment the customer may reasonably rely.
8.4 To the extent permitted by applicable law, liability for damages caused by slight negligence is excluded except where such liability cannot legally be excluded.
8.5 Where NX 3D's liability is excluded or limited, the same limitation applies to its legal representatives, employees, agents, and other persons acting on its behalf, to the extent permitted by law.
8.6 Liability under mandatory statutory provisions remains unaffected.

10. Alternative Dispute Resolution
NX 3D is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board, unless mandatory applicable law requires otherwise.

11.1 The contract language is English.
11.2 Customers may save or print these General Terms and Conditions before submitting their order.
11.3 Order details and legally required consumer information will be provided to the customer as part of the order process and/or order confirmation.
